1. General Terms

2. Bookings & Payments

2.1 All bookings are subject to availability and confirmation.
2.2 A deposit is required for online bookings. Your booking is only confirmed once the deposit is received.
2.3 Full payment must be made before participating in any activity.

3. Cancellation & Refunds

3.1 Cancellations and refunds are subject to our Refund & Cancellation Policy.
3.2 Refunds will be processed via the original payment method within [3] business days upon approval.

4. Customer Responsibilities

4.1 Customers must provide accurate information when making bookings.
4.2 You are responsible for arriving at the designated location on time.
4.3 Customers are expected to follow safety guidelines provided by Long Beach Sabah staff.

5. Liability Disclaimer

5.1 Long Beach Sabah is not liable for any personal injury, loss, or damage arising from participation in our activities, except where caused by negligence on our part.
5.2 Participation in outdoor activities involves inherent risks, including weather-related disruptions. Customers participate at their own risk.
5.3 Our insurance coverage only applies during boat trips and while you are on board our boats. Once you disembark at any destination (e.g., beach, jetty, or island), you are no longer covered under Long Beach Sabah’s insurance, and any activities you participate in thereafter are at your own risk.
5.4 It is the responsibility of customers to ensure they have their own valid health or travel insurance to cover any personal risks, medical emergencies, or incidents that may occur outside of Long Beach Sabah’s insurance coverage.

6. Intellectual Property

6.1 Any photos, videos, or materials taken by Long Beach Sabah during your participation may be used for marketing and promotional purposes unless you opt out by notifying us via email.
6.2 We are not responsible for photos or videos taken by third parties at the jetty, beach, or ocean.

7. Prohibited Use

7.1 You agree not to misuse the website by uploading harmful or illegal content.
7.2 Any attempt to hack, disrupt, or manipulate the website will result in legal action.

8. Third-Party Links

8.1 This website may contain links to third-party websites. Long Beach Sabah is not responsible for the content or practices of those websites.

9. Governing Law

9.1 These Terms & Conditions are governed by and interpreted according to the laws of Malaysia.

Refund & Cancellation Policy

Effective Date: 15th March 2025

At Long Beach Sabah, we strive to provide a seamless experience for all our customers. Our refund and cancellation policies are designed to ensure fairness and clarity. Please read the following terms carefully before making a booking.


1. Deposit Collection

1.1 For online booking, a deposit is required to secure your booking slot.
1.2 Online bookings are only confirmed once the deposit has been received.


2. Cancellation & Refund Terms

2.1 To receive a full refund, cancellation must be made at least 48 hours before the scheduled date; otherwise, the deposit will be forfeited.
2.2 Booking changes are allowed up to 24 hours before the scheduled date.


3. Weather-Related Cancellations

3.1 For island hopping trips, cancellations due to bad weather will be determined by Jesselton Point Jetty management or Long Beach. If a trip is canceled due to weather conditions, customers may choose to reschedule or receive a full refund.
3.2 For sunset watersports activities, cancellations due to bad weather will be determined by the Long Beach ground crew. If weather conditions do not permit the activity, customers may choose to reschedule or receive a full refund.
3.3 If any individual activity within a paid package cannot be carried out due to bad weather or a technical issue from our side, that specific activity will be fully refunded.


4. Technical & Operational Issues

4.1 If a technical issue on our side prevents an island hopping package from being completed, the affected activity will be refunded accordingly.
4.2 In case of a technical failure affecting a sunset watersports activity, the full amount paid customers may choose to reschedule or receive a full refund.


5. Age Declaration Policy

5.1 Customers must provide the correct age information when booking.
5.2 If an incorrect age is declared, we reserve the right to charge the correct package price upon arrival.


6. Cancellation Request Validity

6.1 A cancellation request is only valid if acknowledged by our representative.
6.2 Customers must ensure they receive confirmation of cancellation from our team.


7. Independent Agents & Third-Party Bookings

7.1 If a package is purchased through an independent agent or third-party platform, the customer will be subject to the refund and cancellation policies of that agent or platform.
7.2 Long Beach Sabah is not responsible for any disputes, refunds, or cancellations handled by third-party agents.
7.3 Customers are encouraged to review the policies of the independent agent before making a booking.


8. No-Show Policy

8.1 Failure to show up without prior cancellation will result in a forfeited deposit and no refund.
8.2 Customers are encouraged to inform us as soon as possible if they are unable to attend their scheduled booking.


9. Processing Time for Refunds

9.1 Refunds will be processed within [3] business days from the date of approval.
9.2 The time for the refund to reflect in the customer’s account may vary based on the payment method used.


10. Force Majeure Clause

10.1 In the event of government restrictions, natural disasters, or other force majeure events, we reserve the right to reschedule bookings or issue refunds based on the situation.
10.2 Customers will be informed of any changes or cancellations due to force majeure events as soon as possible.


11. Partial Refunds

11.1 If only certain activities within a package are canceled due to weather, technical issues, or other factors on our side, a partial refund will be provided for the affected activities only.
11.2 Customers will be informed of the refund calculation and the amount they are eligible to receive.

3.3 All bookings made by customers must be honored as per the agreed terms. Failure to do so may result in penalties or removal from the platform.
3.4 Commissions, payouts, and service fees will be outlined in the Agent Agreement provided upon successful registration.
3.5 Agents must maintain professional conduct and provide quality service to customers.


4. Account Security & Privacy

4.1 Users are responsible for maintaining the security of their account credentials.
4.2 Sharing login details with unauthorized parties is prohibited.
4.3 We collect and process user data in accordance with our Privacy Policy.
4.4 By purchasing our products and services, customers grant us the automatic right to use any text, testimonials, comments, images, videos, or any other materials submitted or generated in relation to our business for sales, marketing, and branding purposes without requiring additional written consent. However, customers have the right to opt out by submitting a manual request via email or text message, upon which we will cease using any related materials involving them.
4.5  While participating in activities at the jetty, beach, or ocean, customers acknowledge that they may appear in photos or videos captured by other guests or individuals. Long Beach Sabah does not have the authority to control or demand the removal of such media taken by third parties, and therefore cannot be held responsible for content shared by non-affiliated persons


5. Prohibited Activities

5.1 Users must not engage in fraudulent activities, spam, or unauthorized advertising on the platform.
5.2 Posting illegal, harmful, or misleading content is strictly prohibited.
5.3 Any attempt to manipulate or disrupt the website’s functionality may lead to legal action.


6. Cancellation & Refund Policy

6.1 Customers may request cancellations and refunds in accordance with our Refund Policy.

9. Compliance with Malaysian Laws
